do you have to have photoshop to use photoshop elements ? is it a separate program

They are separate programs. You can download a free 30 day trial of either at adobe.com.

Photoshop Elements is missing some features that the mother program, Photoshop CS4, has, but it's also got some nifty features I'd love to have in the full Photoshop and it's a little more intuitive and prettier to look at, in my opinion.
